    These Conditions regulate the use of the online store www.surfing.shopping.  By accepting them, the User declares that they have read, understand, and comprehend the contents herein and assume all their obligations. If the User does not agree with the content of this document, they must leave this website and will not be able to access or use the services it offers. Likewise, the User expressly and unreservedly accepts that access and use of this website, its services, and the content of these services are under their sole and exclusive responsibility.

    These Conditions will be accepted by the parties without reservation, and may be modified at any time and without prior notice. It is the User's responsibility to read them when making a purchase or contract. The conditions in force at the time of the contract will be applicable.

    User Account and Error Correction

    To make online purchases in this store, you can register by creating a "User Account", or make a quick purchase without registration (as a guest user).

    Shopping at Surfing® is easy and simple, you just have to follow these steps:

    1st.- Select the products you wish to purchase from those offered by Surfing®. By clicking on each product, you will access its product sheet, which includes a detailed description with information, main features and price. If you need more information, do not hesitate to ask us. NOTE: In the case of product sheets with photographs, products may suffer slight variations in color or texture compared to the photograph that appears on the website, due to different factors, for example, the resolution of your monitor. However, we will do our best to ensure that the images are as faithful as possible to reality.

    2nd.- Once you have selected the product(s) you wish to purchase, you must click the "Buy now" button, and the product will be added to your shopping cart. If you wish, you can continue adding more products to the cart, or proceed directly to payment.

    3rd.- Once the product selection is complete, a summary identifying the selected item(s) will appear. Finally, to continue with your order, you must press the "Finish order" button.

    4th.- As we have indicated in the previous sections, when you finalize your purchase, you have the option of doing so by registering, or making a quick purchase without registration (as a guest user).     Surfing® offers you the possibility of paying for your order by bank transfer to our bank account.

In addition, we will send you an email with the order amount, the concept you must indicate and the account number. It is important that, when making the transfer, you indicate your order reference, provided by Surfing® in the email, as the concept to speed up the invoicing and shipping of the order.

    Transfers can take up to 48 hours to become effective, please keep this in mind when considering delivery times. Once payment is confirmed, the order will be invoiced, packaged and shipped.     Surfing® offers you the option to pick up your order at our facilities, located at C/ General Etxagüe 1- 20003, Donostia, Gipuzkoa.

    Shipping conditions

    Shipments will be made to:

    • Peninsular Spain
    • Balearic Islands
    • Canary Islands
    • Any country in or outside the European Community.

    Shipping will be done via a courier company.

    Shipping to the Peninsula is free . In all other cases, both the shipping price and the delivery time will depend on the shipping zone, and will be shown to you before finalizing the purchase.

    The courier company usually delivers during business hours, so if you have any preferred delivery time, you can indicate it in the order comments and we will try to meet it (within the limits of the transport company's route and schedule possibilities).

    Delivery times

    The delivery time is shown during the purchase process, and your acceptance of it is implied.

    In case of non-compliance with delivery deadlines, you must indicate an additional period appropriate to the circumstances that caused the initial delay. In the event that we are also unable to deliver the goods within that additional period, you may terminate the contract. This also applies if the delivery time is essential given all the circumstances surrounding the conclusion of the contract or when you have informed us, before the purchase, that delivery by a specific date or on a specific date is essential. In such cases, you may terminate the contract immediately.

    In any case, if the contract is terminated, the amounts paid will be fully refunded.

    In the event that the User purchases a product that has not yet been released for sale, but already has a release date, the shipping times will be provisional and subject to change, and will be subject to the number of units per product that suppliers have at any given time.     IMPORTANT: In general, we are not responsible for non-compliance or delay of obligations due to causes beyond our control, such as in cases of force majeure (confinement due to a state of alarm, for example), natural disasters, strikes, accidents, etc. Should any incident arise, we will contact you to resolve it.

    Prices, Taxes, Fees, Duties

    Prices are expressed in euros. The prices of Surfing® products may vary, but any changes will not affect orders for which a Shipping Confirmation has already been sent.

    The following taxes will apply to the items on our website:

    • The RRP of items with a shipping address to the Peninsula and the Balearic Islands includes VAT in all cases.
    • The RRP of items with a shipping address to other EU countries, where the buyer is an individual (private customer), includes the VAT of the country of origin.
    • The RRP of items with a shipping address to other EU countries, where the buyer is a company or professional, does NOT include VAT as long as they are registered in the Register of Intra-Community Operators (in which case they must provide us with a valid Tax Identification Code). If not registered as an Intra-Community Operator, the RRP will include the corresponding VAT of the country of origin.
    • The RRP of items with shipping addresses to the Canary Islands and, in general, any non-EU country, does NOT include VAT, as the operation is treated as an export. The price indicated for each item is the final price for shipments to these destinations. Surfing® will not be responsible for the DUA or import costs and taxes (ISPI, IGIC), fees or tariffs generated at the destination customs, if applicable.

    Returns

    At Surfing®, we want you to be satisfied with your order. Therefore, we provide you with several methods to return an item that may not meet your needs or expectations. Possible cases of return or withdrawal:

    1. The product is wrong, has a defect or has been damaged during transport:

    We pay close attention to ensure all our shipments are made correctly. If, even so, you receive a wrong item, please contact us as soon as possible to resolve it. Before opening the product, verify that the packaging matches what was requested: color, size, finish, etc.

    If the products received have any defects or damage, we will respond to non-conformities as set out in the "Guarantees" section within these sales conditions.

    When the product has been damaged during transport, it is necessary that you notify us and, if possible, note the incident on the carrier's delivery note.

    Products must be returned in a protected manner, including them in a box or protective bag. Surfing® makes a transport company available to the buyer for the collection of the goods, completely free of charge. If you wish to return the goods with a transport company other than the one proposed by Surfing®, and the selected transport company offers higher rates, you must bear the difference in the transport cost.

    2. Withdrawal:

    We want you to take care of the planet and not keep anything you don't like, so you can return an item if it doesn't meet your expectations. Therefore, in accordance with the provisions of the LGDCU, and provided that you are a buyer of an item for private use, you have the Right of Withdrawal, by virtue of which you can return the product, provided that it is not a digital product whose download has begun.

    The exercise of this right of withdrawal must be carried out within a maximum period of SIXTY (60) calendar days from its receipt, notifying us of your decision to withdraw from the purchase made (you can use the following withdrawal form template for this, if you wish).     In order to exercise this right, the product must be in perfect condition, and preferably retain its original packaging, as well as all its parts.     The refund of the purchase amount will be made once the condition of the goods has been checked, using the same payment method used in the purchase and, in any case, before 14 calendar days have passed from the reliable receipt of the withdrawal request, provided that Surfing® manages the collection of the item. In the event that you return the item through a transport company of your choice, the 14-day period will begin to run from the time Surfing® has effective knowledge of the shipment of the goods or, failing that, from their receipt.

    * The return costs derived from exercising the right of withdrawal will be borne by the buyer.

    3. If you have not yet received the order:

    If you have not yet received the order and wish to cancel or modify it, you only have to inform us of the changes you wish to make, without any cost if your order has not yet been processed.

    Guarantees

    Except for those that, due to their nature, are excluded from consumer goods guarantee regulations, all our products are guaranteed nationally against manufacturing defects for two years from the date of purchase (or delivery date, if later), or one year if the item is not new.

    We will respond to non-conformities, of which the buyer must inform us within two months of becoming aware of them.

    If the defect or lack of conformity arises within the first 6 months from the delivery of the item, whether it is a new or second-hand product, it is presumed that the defect or lack of conformity already existed when the product was invoiced (or delivered, if at a later time), that is, that there is an original or factory defect of the product, unless we can demonstrate that the defect or lack of conformity is not original but is due, for example, to misuse or maintenance given by the buyer.

    On the other hand, if the defect or lack of conformity arises after the first 6 months and up to 2 years, the presumption that the defect is from the factory does not exist.

    In the event of a defective product, we may proceed, as appropriate, to repair, replacement, price reduction or termination of the contract, all of which will be completely free of charge for the buyer (including transport costs, if any).

    Defects and damage caused by external events, accidents, use not in accordance with our instructions or those of the manufacturer (incorrect use) or normal wear and tear are therefore excluded from the warranty. Also, products modified or repaired by the customer or any other person not authorized by Surfing®, as well as products that are subject to a specific contract. In these cases, the consumer must bear the cost of their repair.

    By regulation, and unless proven otherwise, products will be understood to be in conformity with the contract if they meet all the requirements stated below:

    a) They conform to the description made and possess the qualities of the product that we have presented to the consumer and user in the form of a sample or model.

    b) They are suitable for the uses to which similar products are ordinarily intended.

    c) They present the usual quality and features of a product of the same type that the consumer and user can firmly expect, taking into account the nature of the product.

    Account and Service Deactivation, Cancellation, and Blocking

    User accounts are not deleted due to lack of use. The User can unsubscribe by requesting it from Surfing® staff, by sending an email to info@surfing.shopping or through their account profile.

    In case of non-payment of an order, it may be temporarily suspended until the non-payment situation has been resolved by the User. If more than 15 days pass, Surfing® may proceed with the cancellation of the order.

    Surfing® reserves the right to block access to the User's account without prior notice (or directly delete the User's account) if it is used illegally or violates the obligations and rules established herein, which will be communicated by email. The blocking or deletion of the User's account will have no effect on the obligation to pay for the products purchased, if applicable.

    In exceptional cases, at the free discretion of Surfing® administrators, and evaluating the seriousness of the event, administrators may choose to warn the infringing User before definitively deleting or blocking their account.

    By registering as a User, you agree that the owners of this site reserve the right, being able to act at any time and without prior notice, to modify or discontinue this website and its services, or to delete provided data, either temporarily or permanently.

    Surfing® is deeply committed to complying with Spanish and European personal data protection regulations, and guarantees full compliance with the measures provided, as well as the implementation of the security measures provided in the General Data Protection Regulation (GDPR) (EU) 2016/679, of April 27, and in Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPD). and GDD, hereinafter LOPD).

    When the User registers through the corresponding form, the information we collect includes:

    • Name and surname
    • Email and/or phone
    • Shipping addresses
    • Intellectual Property
    • Username/password

    The User must also provide a password, which must meet certain security requirements. No expiration. To recover the password, the User must go to the specific recovery form and enter their email address to continue the process and modify it, by clicking the link that will be sent to the email address entered. The User is responsible for maintaining the confidentiality of their password, as well as all uses made of it. They must notify Surfing® of any unauthorized use of their account or password as soon as possible.

    Once registered, the User has access to a private panel where they can view certain content, a record of purchases made, etc. They can also manage account options, such as password or User data.

    The User may receive the following notifications:

    • Upon registering on the platform (account validation email).
    • Upon making purchases, such as proof of purchase, incidents, shipments made, etc.
    • The User receives the store's newsletter if they have subscribed to it, from which they can unsubscribe in their User panel and through the corresponding links included at the bottom of the newsletter.
    • For password recovery (specified in the previous field).
    • Upon unsubscribing or deleting the account.

    Security measures

    Users of the Surfing® website are informed that the technical and organizational measures within our reach have been adopted to prevent the loss, misuse, alterations, unauthorized access, and theft of data, thus guaranteeing the confidentiality, integrity, and quality of the information contained therein, in accordance with current data protection regulations. The personal data collected in the forms are processed only by Surfing® staff or by designated Data Processors.

    The Surfing® Website also has SSL encryption, which allows the User to securely send their personal data through the contact or registration forms on the website.

    Accuracy of data

    The User declares that all data provided by them are true and correct and undertakes to keep them updated. The User will be responsible for the veracity of their data and will be solely responsible for any conflicts or litigation that may arise from their falsity. It is important that, in order for us to keep personal data updated, the User informs Surfing® whenever there has been any modification to them.

    Data transfer

    Surfing® will not transfer or communicate your data to any third party, except in legally provided cases or when the provision of a service requires a contractual relationship with a Data Processor. Thus, the User accepts that some of the personal data collected may be provided to these Data Processors (payment platforms, management services, intermediaries, etc.), when necessary for the effective execution of a contracted service or purchased product. The User also accepts that, in case of provision of services, these may be, totally or partially, subcontracted to other individuals or companies, who will be considered Data Processors, with whom the corresponding confidentiality agreement has been agreed, or adhered to their privacy policies, established on their respective websites. The User may refuse the transfer of their data to the Data Processors, by written request, through any of the previously referenced means.

    In addition, in those cases where necessary, customer data may be transferred to certain bodies, in compliance with a legal obligation: Spanish Tax Agency, banking entities, Labor Inspectorate, etc.

    Exercise of user rights

    The LOPD and GDD and the GDPR grant data subjects the possibility to exercise a series of rights related to the processing of their personal data. To do this, the User must contact us, providing documentation that proves their identity (DNI or passport), by email to info@surfing.shopping, or by written communication to the address that appears in our Legal Notice. Said communication must reflect the following information: User's name and surname, the purpose of the request, the address, and supporting data.

    The exercise of rights must be carried out by the User themselves. However, they may be executed by an authorized person as a legal representative of the User, providing the documentation that proves such representation.

    The User may request to exercise the following rights:

    • Right to request access to personal data, which is the right to obtain information about whether their personal data is being processed, the purpose of the processing, if applicable, as well as available information about the origin of such data and the communications made or planned for them.
    • Right to request its rectification, if the personal data is incorrect or inaccurate, or erasure of data that is inadequate or excessive.
    • Right to request the limitation of its processing, in which case only the data strictly necessary for the exercise or defense of claims will be retained by Surfing®.
    • Right to object to processing: refers to the right of the data subject not to have their personal data processed or to cease its processing in cases where their consent is not necessary for the processing, that it concerns commercial prospecting files or that it aims at decisions adopted referring to the data subject and based solely on the automated processing of their data, unless for legitimate reasons or the exercise or defense of possible claims, the data must continue to be processed.
    • Right to data portability: in case you want your data to be processed by another company, Surfing® will facilitate the portability of your data in an exportable format.

    In the event that consent has been granted for a specific purpose, the User has the right to withdraw consent at any time , without affecting the lawfulness of processing based on consent prior to its withdrawal.

    We undertake to execute all these rights within the maximum legal term (1 month).

    If a User considers that there is a problem with the way Surfing® is handling their data, they can direct their complaints to the Security Manager or the corresponding data protection authority, with the Spanish Data Protection Agency being the indicated one in the case of Spain.

    Data retention

    The personal data of Users who use the contact form or send us an email requesting information will be processed for the time strictly necessary to respond to the information request, or until the granted consent is revoked.

    The Customer's personal data will be processed until the contractual relationship ends. The personal data retention period will be the minimum necessary, and may be kept for up to:

    • 4 years: Law on Infractions and Sanctions in the Social Order (obligations regarding affiliation, registrations, cancellations, contributions, payment of salaries...); Letters. 66 years old seq. General Tax Law (accounting books...)
    • 5 years: Art. 1964 Civil Code (personal actions without special term)
    • 6 years: Art. 30 Commercial Code (accounting books, invoices...)
    • 10 years: Art. 25 Law on the Prevention of Money Laundering and Terrorist Financing.
    • No term: disaggregated and anonymized data.

    For their part, the data of Users who subscribe to the newsletter will be kept indefinitely, until the granted consent is revoked.

    In the case of processing candidate data (CV), Surfing® may keep your resume stored for a maximum of two years to include it in future calls, unless the candidate states otherwise.

    Social media

    Surfing® has profiles on some of the main social networks on the Internet (Facebook, Twitter, Instagram, Pinterest), recognizing itself in all cases as the Data Controller for the data of its followers, fans, subscribers, commentators, and other User profiles (hereinafter, followers) published by Surfing®.

    The purpose of data processing by Surfing®, when not prohibited by law, will be to inform its followers about its activities and offers, through any means allowed by the social network, as well as to provide personalized User service. The legal basis that legitimizes this processing will be the consent of the interested party, which may be revoked at any time.
